
Former Supreme Court Justice Antonio Carpio explained how Vice President Sara Duterte's bank records could be obtained if it comes to the impeachment trial. According to him, there are two ways to do this.
One of the ways is to use Republic Act 1405 or the Bank Secrecy Law. Although the law states that bank deposits are confidential, there are exceptions. These include cases of impeachment or if the depositor voluntarily gives permission to inspect the account.
Carpio said the House prosecution could file a motion for subpoena duces tecum. This is an order from the court to produce documents, such as Sara Duterte's bank records at BPI.
He said, “Now, since this is an impeachment case, it is natural for the prosecution to file a subpoena duces tecum to obtain Sara’s bank records from BPI.”
Sara Duterte faced impeachment in February. According to the complaint, more than P2 billion passed through her and her father Rodrigo Duterte's joint accounts from 2006 to 2015.
