
The Supreme Court reversed the decision of the Court of Appeals after it denied the annulment sought by Leonora Dela Cruz-Lanuza against her husband. According to the Supreme Court, miscarriage, abandonment for almost 30 years, and non-payment of alimony can be used as grounds for annulment of marriage.
Leonora revealed that her husband, Alfredo Lanuza Jr., married another woman even though they were still married. In addition, he abandoned the family and did not help or show responsibility for a long time.
According to psychological evaluation, Alfredo has a personality disorder that has made him unable to fulfill his duties as a husband—such as being faithful, responsible, and loving, as stated in Article 68 of the Family Code.
The Supreme Court based its decision on Alfredo's actions and behavior, stating that this was a clear sign of psychological incapacity, which was sufficient reason to annul the marriage.
