
TheCaloocan City Regional Trial Court (RTC) dismissed therape case againstPandi, Bulacan Mayor Enrico Roque and two others after the complainantdid not attend the hearing.
In an order issued on February 25 but only made public this Sunday, Judge Rowena Violago Alejandria of RTC Branch 121 ordered the immediate release of Roque.
According to the court, the complainant has failed to appear at the hearing twice despite the subpoenas sent to him. The subpoena notes state that the complainant's address is “unidentifiable.”
According to Roque's camp, the Department of Justice (DOJ) also issued a resolution on January 22 which cited inconsistencies that cast doubt on the credibility of the complaint.
Furthermore, the case was dismissed due to lack of evidenceand several serious discrepanciesin the details. It was also noted that the complainant's address was wrongand the medico-legal certificatewas suspicious and possibly fake.
Roque's camp continued to insist that the case was “politically motivated” and said it was an attackon his name and reputation.
