Nagreklamo  Bureau of Internal Revenue (BIR) laban kay Mayor Alice Guo ng Bamban, Tarlac sa pag-iwas sa buwis. Kasalukuyang hindi matunton ang nasabing Mayor ng Tarlac.<\/span><\/p>

Noong Agosto 14, isumite ni BIR Commissioner Romeo Lumagui Jr. ang reklamo sa Department of Justice (DOJ). Kasama sa reklamo sina Jack Uy, na bumili ng mga bahagi ng Baofu Land Development Incorporated ni Guo, at Rachelle Joan Malonzo Carreon, ang corporate secretary ng kumpanya.<\/span><\/p>

Ang kaso ay umiikot sa pagbebenta ni Guo ng kanyang mga bahagi kay Uy. Natuklasan ng imbestigasyon ng BIR na walang binayarang capital gains tax (CGT) o documentary stamp tax (DST) sa transaksyon. Ayon kay Lumagui, inakusahan si Guo ng pag-iwas sa buwis na nagkakahalaga ng P500,000.<\/span><\/p>

Ang mga regulasyon sa buwis ay nag-uutos ng pagbabayad ng capital gains tax para sa pagbebenta ng mga bahagi sa pribadong kumpanya, at documentary stamp tax para sa mga transaksyon tulad ng paglipat ng bahagi.<\/span><\/p>

Nahaharap sina Guo, Uy, at Carreon sa mga kasong kriminal dahil sa paglabag sa Section 254 ng National Internal Revenue Code (NIRC) (pagsubok na iwasan o talunin ang buwis) at Section 255 ng NIRC (kabiguan na magsumite ng CGT at DST returns). Bukod dito, nahaharap si Carreon sa hiwalay na kaso sa ilalim ng Section 250 dahil sa kabiguan na magsumite ng mga tiyak na impormasyon.<\/span><\/p>

Ipinaliwanag ni Lumagui na habang ang transaksyon ay kinapapalooban nina Guo at Uy, sinisingil din si Carreon bilang Corporate Secretary dahil sa kanyang papel sa hindi pag-uulat ng hindi pagbabayad at hindi pagsusumite ng mga buwis. Nagsumpa pa siya sa General Information Sheet na naglalaman ng paglilipat kahit na walang bayad na buwis at returns.<\/span><\/p>

Ang BIR ay nagsasagawa rin ng audit sa mga operasyon ng negosyo ni Guo ngunit naghihintay pa ng karagdagang dokumento upang makumpleto ang audit.<\/span><\/p>

Ito ang pangalawang kasong kriminal ni Guo. Noong nakaraan, isang reklamo ng trafficking ang isinampa laban sa kanya dahil sa sinasabing koneksyon sa isang raid na Philippine offshore gaming operator (POGO) sa kanyang bayan. Sa kabila ng arrest order ng Senado para sa hindi pagsunod sa imbestigasyon ng kapulungan, si Guo ay nananatiling hindi matunton.<\/span><\/p>

Noong Martes, tinanggal ng Office of the Ombudsman si Guo mula sa kanyang posisyon, dahil sa matinding pagkakamali. Nahaharap siya sa pagpapatanggal mula sa serbisyo, pagkawala ng benepisyo sa pagreretiro, at permanenteng pagbabawal sa trabaho sa gobyerno.<\/span><\/p>

Sa kasalukuyan, walang arrest warrant para kay Guo habang ang DOJ ay patuloy na nagsusuri sa reklamo ng trafficking. Kung magpasya ang mga taga-usig na magpatuloy, ang kaso ay pupunta sa korte, kung saan maaaring mag-isyu ng warrant.<\/span><\/p>
